Pinal County Attorney Wins First Court Battle Against Board of Supervisors; Case Moves to Maricopa County
FLORENCE, Ariz. (iSkyNews.com) — Pinal County Attorney Brad Miller has won the first round in an ongoing legal dispute with the Pinal County Board of Supervisors after a judge ruled the case should be transferred out of Pinal County.
In a decision issued this week, the Pinal County Superior Court determined that Miller was entitled to a change of venue and ordered the case moved to Maricopa County Superior Court. The court found Maricopa County to be the most appropriate and convenient location for the case to proceed.
The judge rejected arguments from the Board of Supervisors that the case should instead be transferred to Pima County, stating that doing so could lead to more costly, time-consuming, and burdensome litigation funded by taxpayers.
Miller said he supports the court’s ruling and looks forward to litigating the case on its merits in Maricopa County.
The development also affects the county’s immigration enforcement partnership. Miller’s office announced that a Temporary Restraining Order previously obtained by the Board in connection with the 287(g) Task Force Agreement with the Department of Homeland Security has now expired.
With the order no longer in place, the Pinal County Attorney’s Office says it will resume working with federal immigration authorities to track and remove dangerous criminals from the county.
The case will now move forward in Maricopa County Superior Court as the broader legal battle between the county attorney and the Board of Supervisors continues.
