Pinal County to Seek Death Penalty in Murder of Apache Junction Police Officer

Florence, AZ – Pinal County Attorney Brad Miller has announced that his office has filed a Notice of Intent to Seek the Death Penalty against Roger Nunez for the killing of Apache Junction Police Officer Gabriel Facio.

According to prosecutors, the decision followed a thorough review of the facts, evidence, and applicable laws, with input from veteran prosecutors, law enforcement officials, and Officer Facio’s family. County Attorney Miller personally notified the family before making the public announcement.

Authorities allege that Nunez shot Officer Facio in the face during a traffic stop after the suspect was pulled over for allegedly brandishing a firearm in a road-rage incident in Apache Junction. Prosecutors say the murder meets statutory aggravating factors under Arizona law, including the killing of a peace officer in the line of duty.

"This decision was not made lightly," Miller said. "It reflects the gravity of the crime and our commitment to seeking justice for Officer Facio, his family, and the community."

Nunez remains accused and is presumed innocent unless proven guilty.

The Pinal County Attorney’s Office, led by Miller—a former Marine Corps Reserve Lieutenant Colonel and seasoned prosecutor—prosecutes more than 2,500 felony cases and 1,000 misdemeanors annually.
